By accessing or using our website, mobile applications, or any of our services (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

We may modify these Terms at any time. If we make changes, we will provide notice of such changes by updating the date at the top of these Terms. Your continued use of our Services following the posting of revised Terms means you accept and agree to the changes.

4. Account Registration
To access certain features of our Services, you may be required to create an account. 4.1 Afterly - Product Ownership Management
For Afterly users, the following additional terms apply:
- Account Required: All users must create an account with email and password. No guest mode or device-only accounts are available.
- Free Tier: Free accounts can add 1 product per day, upload 3 images per product, and access basic warranty and EMI tracking features. All data is backed up to the cloud.
- Premium Subscription: Premium accounts (US$2.99/month or US$24.99/year) provide unlimited products, 20 images per product, email import from Gmail/Outlook, AI-powered resale value estimates, and advanced features.
- Email Import Consent: Email import is optional and requires explicit OAuth consent. We only scan purchase-related emails and never access personal messages. You can revoke access at any time.
- Data Accuracy: You are responsible for the accuracy of product information, warranty dates, and payment schedules you enter. We are not liable for missed warranty claims or late payments due to incorrect data entry.
- Warranty Reminders: Warranty and EMI reminders are provided as a convenience and do not constitute legal advice. Always verify warranty terms with the manufacturer or retailer.
- Payment Processing: Premium subscriptions are processed through Stripe. By subscribing, you agree to Stripe's terms and authorize recurring charges.
- Cancellation: You may cancel your premium subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds for partial periods.
- AI-Generated Content: Resale value estimates and AI-extracted product data are provided for informational purposes only and may not be accurate. Always verify with authoritative sources before making financial decisions.
5. User Content
Our Services may allow you to create, upload, post, send, or store content. You retain all rights in any content you submit, post, or display through our Services. By making your content available on our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display your content in connection with operating and providing our Services.
5.1 Uploaded Documents and Images
For content you upload (receipts, invoices, warranty documents, product photos):
- You represent and warrant that you own or have the necessary rights to upload the content.
- Uploaded content is stored securely in cloud storage (Supabase) and is only accessible to you.
- We may process uploaded images and documents using AI services (OpenAI) to extract text and structured data for your benefit.
- You can delete your uploaded content at any time, which will permanently remove it from our servers.
5.2 AI-Generated Content and Third-Party Services
Our Services use artificial intelligence and third-party APIs to enhance functionality:
- OpenAI API: We use OpenAI's language models for content generation, email parsing, and product data extraction. Data sent to OpenAI is subject to their Terms of Use and Privacy Policy.
- Stripe: Payment processing for premium subscriptions is handled by Stripe. See Stripe's Terms.
- Firebase Cloud Messaging: Push notifications are delivered via Firebase. See Firebase Terms.
- Gmail/Outlook OAuth: Email import requires OAuth consent and is subject to Google's and Microsoft's terms.
- AI-generated content (resale estimates, extracted data) is provided "as is" without warranty of accuracy.
6. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Violating any applicable laws or regulations
- Impersonating any person or entity
- Interfering with or disrupting the Services
- Uploading viruses or malicious code
- Attempting to gain unauthorized access to our systems
- Collecting user information without consent
7. Termination
We reserve the right to suspend or terminate your access to our Services at any time for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease.
7.1 Subscription and Billing (Premium Services)
For premium subscription services (Afterly Premium):
- Billing Cycle: Subscriptions are billed monthly or annually based on your selected plan.
- Auto-Renewal: Subscriptions automatically renew unless cancelled before the end of the current billing period.
- Cancellation: You can cancel at any time through your account settings. Cancellation takes effect at the end of your current billing period.
- No Refunds: We do not offer refunds for partial subscription periods or unused premium features.
- Price Changes: We may change subscription prices with 30 days' notice. Price changes apply to new billing periods only.
- Free Trial: If we offer a free trial, your subscription will automatically convert to paid unless cancelled before the trial ends.
- Payment Failures: If a payment fails, we may suspend premium features until payment is successful.
8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Specific Disclaimers for Afterly:
- Reminder Accuracy: While we strive to send timely warranty and payment reminders, we cannot guarantee delivery or accuracy. You are solely responsible for tracking your own warranties and payment obligations.
- AI-Generated Content: Resale value estimates, email parsing results, and AI-extracted product data may contain errors. Always verify information from authoritative sources.
- No Financial Advice: Resale value estimates and product recommendations are for informational purposes only and do not constitute financial, investment, or legal advice.
- Third-Party Services: We are not responsible for the accuracy, reliability, or availability of third-party services (Stripe, OpenAI, Firebase, Gmail, Outlook).
- Data Loss: While we implement industry-standard security measures, we are not liable for data loss or corruption due to technical failures, security breaches, or force majeure events. You should maintain your own backups of important documents.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL cosmiklore, ITS DIRECTORS, EMPLOYEES, PARTNERS, SUPPLIERS, OR CONTENT PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
